Self-regulating platforms?

چکیده

The deadline for the transposition of Directive (EU) 2019/790 (the CDSM Directive) into national law expired on 7 June 2021. Some EU Member States have failed to perform transposition, and so they also introduce new obligations under Article 17 prescribing brand requirements that online content-sharing service providers (OCSSPs) shall comply with. As a part these rules, OCSSPs amend their end-user licence agreements (EULAs) include terms enforcement mandatory limitations exceptions (quotation, criticism, review, as well use purpose caricature, parody pastiche) 17(7) establishment an effective complaints redress mechanism regarding removal user-generated content in line with 17(9). In second phase our ongoing EU-funded research project, we examined extent which specific amended EULAs meet obligations. Our empirical data show that, besides only little progress, sources conflict emerged.
